The European Union’s Artificial Intelligence (AI) Act was recently discussed at a trilogue meeting of three key bodies of the EU as part of the last phase of negotiations, on October 24, 2023. Creative Commons (CC) collaborated with Communia to summarize their views emphasizing the importance of a balanced and tailored approach to regulating foundation models and of transparency in general. These views emphasized the support for more transparency around training data for regulated AI systems, and that the existing copyright flexibilities for use of copyrighted materials such as for text and data mining exceptions for scientific research purposes provide a suitable framework for AI training. They also advocated for a practical and proportionate approach to meeting the transparency obligation to support the smaller players, in order not to stifle AI innovation.
